On 15 September 2026 the U.S. Senate refused to open debate on the Clarity Act. The tally was 49 yeas and 50 nays. The bill on market structure for digital assets fell. What remains in force is GENIUS, the spot crypto funds, the SEC’s temporary exemption and the letter to DTCC for tokenization in October. The European Union already applies MiCA.
In 528 Justinian charged a commission under Tribonian with putting the empire’s law in order. The emperor wanted one empire, one faith and one law. For centuries the courts had wandered among imperial constitutions and the opinions of the old jurists. The texts contradicted one another. In the years that followed came the Codex, the Digest and the Institutes. In the East the state at last had a code by which judgment ran the same from the capital to the provinces. In the West the Senate had long ceased to govern the provinces, and grain still went down to Ostia on the old road. Constantinople’s compilation would enter European law only centuries later, when Bologna opened it. The stone had not waited.

The Senate did not pass the bill. The road is already laid.
What the Clarity Act is and why the Senate stopped it
The House passed the Digital Asset Market Clarity Act in July 2025 by 294 votes to 134. The Senate Banking Committee reported it on 14 May 2026 by 15 votes to 9. H.R. 3633 split oversight between the SEC and the CFTC. It said which token is a security and which is a commodity, and it provided for the registration of exchanges and intermediaries. GENIUS, enacted in July 2025, already governs the payment stablecoin. Clarity was meant to be the second statute. Without it the commissions write only where existing law gives them a footing.
On 14 September the Republicans released about 630 pages. Senators Lummis, Boozman and Scott announced 126 amendments. The White House accepted the ethics title. A senior official holding a material stake in a token issuer sells the interest or places it in a blind trust. Senior office-holders may not create or sponsor digital assets while in post. State attorneys general receive standing to sue. An intermediary may not pay interest merely for holding a payment stablecoin. A reward tied to turnover, payment or a service remains. The Treasury secretary may suspend those rewards for a time if community banks lose deposits.
The Democrats wanted a sale, not a trust. President Trump has disclosed more than $1.4 billion of income from a family crypto network for 2025. The circle includes World Liberty Financial and the family memecoin. Senator Warren called the clause a “fig leaf”. Enforcement, she said, would rest with the same president’s Justice Department. Senator Gallego refused “time to commit a crime”. The banks wanted a ban on intermediary rewards before harm arrived. Senators Hawley and Moran voted with them. State attorneys general, with James among them, warned that the text cut their power against fraud.
On 15 September cloture drew 49 yeas and 50 nays. Sixty were required.
Table 1. The Senate arithmetic on the Clarity Act
| Item | Tally |
|---|---|
| Votes needed to open debate | 60 |
| Yeas | 49 |
| Nays | 50 |
| Not voting | Coons (Delaware) |
| Republican seats | 53 |
| Democrats needed if the caucus held | 7 |
| Democratic votes obtained | 0 |
| Republicans voting no | Collins, Hawley, Moran, Tillis |
Senator Tillis voted no in order to file a motion to reconsider. The motion sits on the calendar. Without seven votes it is not a chance. The House has already passed its text. There is nothing to revote until 3 November shows who holds Congress.
Polymarket cut the probability that the Clarity Act would pass in 2026 from about 82 per cent in February to about 7 per cent after the vote. The industry has spent $300 million across two election cycles. The sum did not buy seven votes.
For this Senate, crypto is bound up with President Trump. The next draft begins with ethics. The SEC has said for months that it will write rules without the statute. That is why Chairman Atkins moved after Tuesday.
Crypto funds and the five sessions after the vote
Table 2. Crypto funds and the five sessions after the vote
| Day | Event | Fund flows |
|---|---|---|
| Monday, 14 September | Final Clarity Act text | Bitcoin about +$160 million; ether about +$121 million; Solana about +$11 million |
| Tuesday, 15 September | Vote 49-50 | Outflows begin |
| Wednesday, 16 September | Fed raises the funds rate to 3.75-4.00 per cent | Bitcoin and ether together more than -$1.1 billion on 15-16 September; bitcoin about -$746 million over two days; XRP about +$3.5 million; Solana a small plus |
| Thursday, 17 September | SEC exemption | Bitcoin about +$160 million, almost all through IBIT |
| Friday, 18 September | Bitcoin above $81,000 | Bitcoin more than +$300 million |
Bitcoin fell through $76,000 and touched about $74,900. Coinbase shares lost more than 8 per cent. The premium to offshore exchanges sank to a one-month low. Short-term holders sent tens of thousands of bitcoin to exchanges at a loss. U.S. spot demand shrank. The global price held the Tuesday trough.
On Wednesday the market had priced a Fed hike at more than 90 per cent. The dollar firmed after the decision. A muted response to the rate does not prove strength in bitcoin. It proves the news had already been paid for.
Three figures explain Friday. The premium had already shown weak U.S. spot demand. IBIT pulled money on Tuesday and Wednesday and returned part of it at the week’s end. Exchange shares moved more sharply with the headlines. The conclusion is drawn from flows, the premium and the exchange stocks. Basis and open interest in the futures do not enter this account. Friday refuted panic. It did not prove fresh demand.
What remains in force after the Clarity Act failed
Table 3. What remains in force after 15 September 2026
| In force after 15 September 2026 | Still absent |
|---|---|
| GENIUS | The Clarity Act as statute |
| Spot funds on bitcoin, ether, Solana and XRP | CFTC spot authority over a digital commodity |
| The Regulation Crypto Assets proposal - comments to 20 October | A commodity label by statute |
| The SEC exemption of 17 September, for five years | A ready market in a tokenized U.S. stock for the domestic retail client |
| The letter to DTC of 11 December 2025, for three years | Mutual recognition with MiCA |
| Live DTC trades from 15 July; a commercial service in October 2026 | Stellar in 2027 as a fact |
| MiCA in the Union from 1 July 2026; 346 licensed firms as of 18 September | The British perimeter before 25 October 2027 |
MiCA and the American order

The comparison is not between two live market-structure statutes. MiCA is a regulation. Clarity did not pass.
Table 4. MiCA and the American order
| Rule | European Union (MiCA) | United States |
|---|---|---|
| What the rule asks | What the token does | Who supervises it |
| Market structure for the crypto-asset | Yes; in force from 1 July 2026 | No; the Clarity Act fell on 15 September |
| Payment stablecoin | EMT and ART | GENIUS |
| Interest at the issuer | Banned | Banned |
| Reward at the intermediary | Banned under Articles 40 and 50 | Open until supervision or a court closes it |
| Reserve | A share in an EU bank: 30 per cent; 60 per cent for a significant EMT | Short Treasuries, repo, money-market funds |
| Passport | One licence for the Union | None; fifty states and a federal overlay |
| Mutual recognition | None | None |
| Tokenized stock with shareholder rights | Often securities and settlement law, not MiCA | DTC and the SEC exemption |
| What the order confers | Licence, passport, a closed interest ban | Fund, sovereign paper, depository |
A large platform works under three regimes at once. In the Union it has a MiCA passport and a closed reward on balances. In the United States it has a spot fund, a reward at the exchange until the rule is rewritten, and a temporary exemption for a stock with rights. At the depository the twin - a tokenized entitlement - is available only to a DTC participant.
Tether left European venues for the retail client. Circle holds an e-money token licence for USDC from France. Two houses, two reserves.
DTCC tokenization in October 2026
DTC is the DTCC company that keeps the book. Positions of more than $114 trillion sit there.

On 11 December 2025 the SEC gave DTC a no-action letter for three years.
Table 5. Steps in DTC tokenization
| Step | What happens |
|---|---|
| 1 | A DTC participant instructs through the service gate |
| 2 | The classic position is taken down |
| 3 | The record moves into a digital omnibus account |
| 4 | A twin with the same CUSIP enters a registered wallet on an approved network |
| 5 | The security does not leave the depository |
| 6 | The reverse path burns the token and restores the classic book |
Eligible assets are the constituents of the Russell 1000, large index funds and U.S. Treasury bills, notes and bonds. That is the top of the market.
Table 6. DTCC tokenization calendar
| Date | Event |
|---|---|
| 11 December 2025 | SEC letter for three years |
| 15 July 2026 | Live trades at more than 30 firms on Besu and Canton |
| October 2026 | Commercial service for participants |
| First half of 2027 | Stellar - an intention |
July proved the path works. It did not prove the two forms will trade without a spread. The July prints did not run through a dividend or a vote, and margin at the central counterparty remains a trial rather than daily use of the token as collateral.
The synthetic product at Robinhood and Kraken tracks the price without a vote. Coinbase sells one-for-one records outside the United States. DTC keeps the American book. These are three different products.
The July trades give no volume threshold. Whether billions in collateral and repo pass through the twin will show in participants’ winter reports.
Which crypto assets still hold the gate after the Clarity Act
Table 7. Crypto assets after the Clarity Act
| Asset | What it holds after 15 September | What it did not get |
|---|---|---|
| Bitcoin | The spot fund; outflows did not break the structure | A commodity statute - the fund did not need one |
| Ether | Tokenization outside the depository, on a long horizon | The DTC path this autumn (Besu and Canton) |
| Solana and XRP | A fund | A commodity label |
| Payment stablecoin | Issuance under GENIUS; in the Union, an e-money token or an exit from retail | A closed reward at the U.S. intermediary |
| A memecoin tied to the president | Attention | A place beside the fund and the depository |
| Exchange shares | Four revenues with four fates | Treatment as a single trade until December |
Table 8. Exchange revenues after the vote
| Exchange revenue | After the vote |
|---|---|
| Spot trading fee | Survives without Clarity |
| Reward on balances | Open in America, closed under MiCA, under watch toward 2027 |
| Token for a foreign client | Works |
| Token for a U.S. client | Waits on the SEC venue and the issuer’s consent |
| Twin at DTC | Does not accrue to the exchange’s take; it clears through a participant, the clearing house and firms such as BlackRock |
What to expect through the end of 2026 from the Senate, the SEC and the market
The Senate will not gather 60 votes for the Clarity Act while crypto is bound up with the president. Tillis’s motion is a date without votes. If one chamber changes hands on 3 November, the text is written again from ethics.
The SEC takes comments on Regulation Crypto Assets until 20 October. A suit against the exemption is possible in the same calendar. DTC opens tokenization for participants in October. The Fed has left a door for another hike. The first number for U.S. spot demand remains the flow in IBIT.
Order of risk reduction
Do not add size only because the statute is expected before Christmas.
If risk is cut before the next Fed move, exchange shares come first. Friday already recovered Tuesday’s loss. Next come the tokens that carried the “commodity” label. Then spot ether, if the thesis is tokenization at the depository - this autumn the path does not run through it. The core bitcoin holding is measured by IBIT flows. Three more days of outflow after Monday would undo the claim that Friday brought buyers back.
The DTC twin is not bought from this book in October. That conclusion runs through the custodians already at the depository and in clearing. The synthetic record is not placed beside them.
The European e-money token does not wait on the Senate. The American reward on balances is held as a privilege until the rule is rewritten. A spot crypto fund is bought through a broker. The DTC book on day one is not a product for the European retail holder.
This is an order for cutting risk. It is not an allocation with weights.
Conclusion
The SEC letter to DTC runs to 2028. Traffic still clears on that infrastructure. It is not a code.
The Union closed interest at the intermediary and gave the venue a passport under MiCA. America gave the spot fund and the depository. In October 2026 DTCC issues a twin of the blue-chip and of Treasury paper.
Whoever waits on a Senate session in December is holding an expectation that the vote did not confirm.
Questions and answers
What is the Clarity Act?
The Digital Asset Market Clarity Act (H.R. 3633) was meant to split oversight of crypto assets between the SEC and the CFTC, to say which token is a security and which is a commodity, and to register exchanges and intermediaries. The House passed it in July 2025. The Senate refused to open debate on 15 September 2026.
Why did the Senate reject the Clarity Act?
Cloture required 60 votes. The count was 49 yeas and 50 nays. Republicans hold 53 seats. They received no Democratic vote. They lost four of their own. The fight over ethics around the president’s crypto income and over rewards on stablecoins at the intermediary broke off the talks.
How do MiCA and GENIUS differ?
MiCA is the European regulation of the crypto-asset and of the venue. It has applied since 1 July 2026. It bans interest at the issuer and at the intermediary. GENIUS is a U.S. statute for the payment stablecoin only. It bans interest at the issuer. The reward at the exchange stays open until supervision closes it.
How does DTCC tokenize entitlements to stocks?
DTC keeps the book. A participant instructs a twin with the same CUSIP into a registered wallet. The security itself does not leave the depository. The SEC letter is dated December 2025 and runs for three years. Live trades have run since 15 July 2026. The commercial service is for October 2026. Access is for a DTC participant, not for the retail client.
